General Terms and Conditions (AGB)

1. Scope of Application
These General Terms and Conditions (“GTC”) apply to the business operations of Samansy by Zimmerli, 8006 Zurich (hereinafter “the Company”). The Company sells jewelry, accessories, and related products via its online platform and other sales channels and provides both paid and free services in this context.

These GTC apply to all of the above-mentioned areas as well as to other services that the Company provides directly or indirectly to the customer

2. conclusion of contract
The contract is concluded when the customer accepts the company's offer regarding the purchase of services or products.

The contract is also concluded when the customer makes use of the services offered by the company or purchases or uses the company's products.

3. prices
All prices are quoted in Swiss francs (CHF) and are inclusive of any applicable value added tax (VAT) and any other taxes.

The company reserves the right to change prices at any time. The prices on the website or according to a separate price list valid at the time the contract is concluded shall apply.

4. payment
The customer undertakes to pay the invoiced amount within 30 days of the invoice date, unless payment has already been made during the order process via credit card, Twint or other payment systems.

In the event of late payment, the customer will be sent a reminder and will automatically be in default after the deadline has expired. From this point onwards, the customer shall owe default interest of 5%.

The company reserves the right to demand payment in advance and to refuse to provide the service or deliver the product in the event of late payment.

5. obligations of the company

5.1. provision of services
The company fulfills its obligations by providing the agreed services.

5.2. auxiliary persons
The company is entitled to call in third parties to fulfill the contract, whereby the statutory provisions are observed.

6. obligations of the customer
The customer is obliged to make all necessary arrangements for the provision of the service in good time.

The customer confirms that he/she is legally competent and of legal age and that the information provided is true.

7. delivery and return

7.1. delivery
Delivery is made in accordance with the conditions stated on the website.

7.2. return
An exchange or return is only possible in the event of defects. The customer must report the defect immediately.

8. Retention of title
Ownership of the products shall remain with the company until the purchase price has been paid in full.

9. Liability
The company is not liable for indirect or consequential damages. Liability for direct damages is limited to the amount of the product or service purchased.

10. data protection
The company treats personal data confidentially and uses it in accordance with the applicable data protection regulations.

11. Amendments
These GTC may be amended at any time and shall enter into force upon publication on the website.

12. Applicable law / place of jurisdiction
These GTC are subject to Swiss law. The place of jurisdiction is Zurich.
